1.1 These General Sales Conditions apply exclusively to all offers, orders, and agreements of JJ Footwear, to the exclusion of any other terms and conditions.
1.2 Acceptance of an offer or placing an order implies acceptance of the applicability of these conditions.
1.3 Deviations from these conditions can only be made in writing, in which case the remaining provisions shall remain in full force.
1.4 All rights and claims stipulated for JJ Footwear in these conditions and any subsequent agreements are equally stipulated for the benefit of intermediaries and third parties engaged by JJ Footwear.
2.1 An agreement is only concluded upon acceptance of your order by JJ Footwear. JJ Footwear is entitled to refuse orders or attach certain conditions to the delivery, unless expressly stated otherwise. If an order is not accepted, JJ Footwear will notify you within ten (10) working days after receiving the order. It should be explicitly mentioned here that sales prices for our products starting from €0 do not appear on our website and are due to a technical flaw. These orders will be refused and not delivered.
3.1 All offers from JJ Footwear are without obligation, and JJ Footwear expressly reserves the right to change prices, particularly if required by (legal) regulations.
3.2 All prices are stated in euros, including VAT, and excluding shipping costs (if applicable).
4.1 JJ Footwear maintains a delivery time of 1 to 2 days (excluding Sundays). The delivery times provided by JJ Footwear are indicative only. Exceeding any delivery period does not entitle you to compensation.
5.1 All items can be returned within twenty-one (21) days of receipt without any problems. However, it is explicitly stated that the items must be delivered to JJ Footwear in undamaged and original condition, in accordance with the Distance Selling Act. If this aspect is not taken into account, we cannot accept the items for return. The enclosed return form must be filled out and included with the return shipment.
5.2 You are obliged to check whether the items delivered to your home meet your order. If this is not the case, you should notify JJ Footwear within seven (7) days by email, stating the order number in the subject of your email, and provide a clear explanation of why the item does not meet your expectations. JJ Footwear will replace the item.
5.3 Boots must be returned in their original condition within 30 days of your order date in order to be issued a full credit to your credit card account (pending our inspection of the boots). Once you receive your boots, please try them on ASAP and pay close attention to return dates so that you can return your products immediately after receiving a return authorization number. We cannot accept any worn or damaged boots for return and they must be in their original re-saleable condition (without fingernail scratches, soles must be clean, heels must not be scraped, leather cannot be creased or scuffed, etc.). If you are using your own carrier, it is recommended that your item be insured in case of loss or damage and that you obtain a tracking number for your return.
5.4 Any item to be returned or exchanged must be unworn and shipped in its original carton and condition (with all boot packing materials). Please make sure not to tape the actual boot carton and to use an outer shipping carton. PLEASE DO NOT PLACE LABELS OR WRITE DIRECTLY ON THE BOOT BOX. There will be a $5 re-boxing fee for any boot that is returned without its original box or if the original box is ruined by taping over it. We do not have access to extra cartons since we do not manufacture these boots and they must be returned in condition to be sold as new.
5.5 Boots returned past 30 days of the invoice date may be issued a store credit (pending our inspection of the boots) that can be used for any future purchase and these late returns are subject to company discretion. Any delinquent return will be given a store credit for the current price of the item. If it is on sale the store credit will be issued for the current sale price.
We accept Visa, Master Card, Discover, Amex, PayPal and PayPal Bill Me Later. We also accept Visa and Master Card debit cards. All cards are subject to address verification by your financial institution at the time of your purchase. Please note that we do not accept cash, personal checks or money orders for online purchases, nor do we ship orders C.O.D.
7. Reservation of Ownership
7.1 The risk regarding the products passes to the customer at the time of delivery.
8.1 Warranty for purchases through a retailer: The warranty for items purchased through a retailer will be handled by the respective retailer.
8.2 Warranty for purchases through the JJ Footwear webshop: JJ Footwear provides a warranty for models up to one season back. The warranty only covers manufacturing defects, which are assessed by the complaints department of JJ Footwear. If you wish to make a warranty claim, you can send an email to [email protected]. Please note that there is no warranty for patent leather boots. If the warranty period has expired, you can have your item repaired at your own expense and risk. No warranty is provided for zippers and trimmings.
Claims will not be processed if it is found that the counterparty or a third party has made changes or repairs to the item, except in cases where this was done with the knowledge and permission of the seller and unless the change or repair is unrelated to the work to be performed by the seller.
8.3 Warranty for trade shows and events: The same warranty conditions as for purchases through the webshop apply to items purchased at trade shows and events. However, there is no warranty for items sold at significantly reduced prices (this will be notified in advance).
9. Complaints and liability
9.1 You have the obligation to examine the products upon delivery to ensure that they comply with the agreement. If this is not the case, you must inform JJ Footwear in writing as soon as possible, but in any case within seven (7) days after delivery, or as soon as reasonably possible after discovering the non-compliance.
9.2 If you do not wish to accept a product, you have the right to return it to JJ Footwear within fourteen (14) days after delivery. In this case, returns will only be accepted if the product and its original packaging are undamaged.
10. Electronic communication and evidence
10.1 JJ Footwear is not liable for misunderstandings, distortions, delays, or any failure in the proper transmission of data and messages resulting from the use of the internet or any other means of communication in the traffic between the customer and JJ Footwear (or any third parties involved), unless there is proven intent or gross negligence on the part of JJ Footwear.
10.2 The administration of JJ Footwear serves as complete evidence of the existence, content, and execution of the agreement with the customer in any legal proceedings, unless there is counter-evidence presented by the party claiming that the evidence is not reliable.
11. Force majeure
11.1 Without prejudice to its other rights, in the event of force majeure, JJ Footwear has the right to suspend the execution of your order or to terminate the agreement without judicial intervention, at its own discretion. JJ Footwear shall notify you of such actions in writing and will not be obligated to pay any compensation, unless it would be unacceptable under the given circumstances according to the standards of reasonableness and fairness.
11.2 Force majeure refers to any circumstance beyond the control of JJ Footwear, which cannot be attributed to its fault and for which JJ Footwear is not responsible under the law, legal acts, or prevailing opinions.
12.1 If one or more provisions of these conditions or any other agreement with JJ Footwear are in conflict with any applicable legal provisions, the respective provision will cease to apply and will be replaced by a new legally permissible and comparable provision determined by JJ Footwear.
12.2 JJ Footwear is authorized to use third parties in the execution of your order(s).
13. Applicable law and competent court
13.1 Dutch law exclusively applies to all rights, obligations, offers, orders, and agreements to which these terms and conditions apply, as well as to these terms and conditions themselves.
13.2 Any disputes between the parties will be exclusively submitted to the competent court in the Netherlands.
